Pizza Hut Endo (2013)
Naps, one of 3000 contractuals working for Philippine Pizza Inc., has delivered pizzas for 13 years. Yet his employer was Consolidated Building Maintenance, Inc. (CBM), an agency. This is considered "labor only contracting," which is prohibited by law.
When the Philippine Pizza Inc. Employees Union (PPIEU) attempted to assist CBM contractuals to file for regularization, 19 were sacked, including Naps. The union had been organizing for certification elections on June 14, 2013, and was attempting to move around 300 contractuals to Philippine Pizza Hut Inc. (owned by the Araneta family), to become regular employees there. CBM responded by immediately terminating 19 of these workers while the remaining workers, some with 15 years of service, were denied their request to transfer.
In the meanwhile, Pizza Hut Union lost its certification elections by a narrow margin. Union secretary "Jazz" Mamasabulod de Leon attributes the election loss to management interference and intimidation. Many of the 104 permanent employees were unable to attend the elections due to management changing their work schedules; others were threatened with termination if they attended or voted "yes" to the union.
This abuse highlights how vulnerable ENDO employees are to being outright fired whenever they make the slightest attempt to organize, despite many years of loyal service. Yet it also stands as an example of cooperation between contractuals and regulars in the fight for their human right to security of tenure in the workplace.
